Terms of use

1Acceptance

These terms govern your use of the Seeds of Infinity game (the “Game”) and of the seedsofinfinity.app website with its tester waitlist (the “Site”), offered by DevStacks Software Engineering LTDA, CNPJ 43.756.177/0001-25 (“DevStacks”, “we”). By downloading, installing or using the Game, or by using the Site, you agree to these terms and to our privacy policy. If you do not agree, do not use the Game or the Site.

2License to play

We grant you a personal, limited, non-exclusive, non-transferable and revocable license to install and use the Game on devices you own or control, for personal, non-commercial enjoyment, in accordance with the rules of the store you got it from. Except where the law expressly allows it, you may not:

• copy, sell, rent, sublicense or distribute the Game or any part of it;
• modify, decompile or reverse engineer the Game, or extract its content, such as artwork, text, music and sounds;
• use the Game or its content for commercial purposes, including training artificial intelligence systems;
• remove copyright or trademark notices.

You may publish screenshots, videos and streams of your matches, as long as you do not resell the Game’s content.

3Intellectual property

The Game and the Site, including cards, text, artwork, music, sounds, code, names and marks such as Seeds of Infinity and Namar, belong to DevStacks or its licensors and are protected by copyright and industrial property laws. Third-party materials included in the Game, such as public domain recordings, are used under their licenses. This license does not transfer any ownership rights to you.

4Beta versions

Versions distributed through TestFlight or Google Play testing are versions in development. They may have bugs, change, stop working or expire, and your progress may be lost from one version to the next. Taking part is free and voluntary, and you can leave whenever you want.

You may comment on and share your impressions of the beta, but you may not redistribute the Game’s files or your tester access. Feedback and suggestions you send us may be used freely to improve the Game, with no obligation to pay or credit you.

5The tester waitlist

By signing up, you confirm that you are 16 or older, that the email address is yours and that your details are true. Signing up does not guarantee an invitation: places depend on the platforms’ limits and on the needs of the beta, such as country and type of device. You can leave the list at any time by writing to [email protected].

6Use of the website

Do not use the Site to sign up other people without their permission, send false information, sign up automatically, overload or attack our systems, or for any unlawful purpose. We may refuse or delete signups that break these terms.

7Price and purchases

The Game is free during the beta. If we ever offer the Game or content for a price, the price will be shown before you buy, and payment, refunds and subscriptions will be handled by Apple or Google under each store’s terms.

8Warranties and liability

We build the Game and the Site with care, but they are provided as is and as available. To the extent the law allows, we do not guarantee that they will work without interruptions or errors, or that they are fit for a particular purpose.

To the extent the law allows, DevStacks is not liable for indirect damages, lost profits or lost progress in the Game, and our total liability is limited to the amount you paid us for the Game in the 12 months before the event. These limitations do not apply to willful misconduct or gross negligence, and they do not affect the rights you have as a consumer, including under Brazil’s Consumer Protection Code and the consumer protection laws of your country.

9If you got the Game from the App Store

• These terms are between you and DevStacks, not Apple Inc. (“Apple”). DevStacks, not Apple, is solely responsible for the Game and its content.
• The license lets you use the Game on any Apple-branded product that you own or control, as permitted by the Usage Rules in the App Store Terms of Service, including by accounts associated with you through Family Sharing or volume purchasing.
• DevStacks is solely responsible for maintaining and supporting the Game. Apple has no obligation whatsoever to provide maintenance or support.
• If the Game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the Game, if any. To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the Game.
• DevStacks, not Apple, is responsible for addressing any claims relating to the Game, including product liability claims, claims that the Game fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy or similar laws.
• If a third party claims that the Game or your use of it infringes their intellectual property rights, DevStacks, not Apple, will be responsible for the investigation, defense, settlement and discharge of that claim.
• You represent that you are not located in a country subject to a United States Government embargo, or designated by it as a “terrorist supporting” country, and that you are not listed on any United States Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms when using the Game.
• Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, will have the right to enforce them against you.

10If you got the Game from Google Play

The Google Play Terms of Service also apply. Google is not a party to these terms and is not responsible for the Game.

11Termination

You can stop using the Game and uninstall it whenever you want. We may suspend or end your license if you break these terms. We may also change or end the Game, the Site or the beta, giving reasonable notice when a change affects you significantly.

12Changes to these terms

We may update these terms. The date of the last update is at the top of the page and, if a change is significant, we will announce it on the Site or in the Game before it takes effect. Continuing to use the Game or the Site afterwards means you accept the new version.

13Governing law and venue

These terms are governed by the laws of Brazil. The courts of Porto Alegre, RS, have jurisdiction, without prejudice to your right, as a consumer, to bring a claim in the courts where you live. If you live in another country, the mandatory protections that its laws give consumers still apply.
